Terms of Service
Last updated 8 September 2026
The terms on which you may use Talakay. Read section 3 in particular — it explains what this platform is and, more importantly, what it is not.
Unreviewed draft — not legally binding
This document was drafted with AI assistance and has not been reviewed by a lawyer. It is a starting point for legal review, not a finished agreement, and it must not be relied upon by anyone. A qualified attorney licensed in the relevant jurisdiction must review and approve this text before the platform accepts payment or onboards users outside a closed test.
1.Who these terms are between
These terms are an agreement between you and the operator of Talakay (“we”, “us”). By creating an account or using the platform, you agree to them. If you are agreeing on behalf of a firm, you confirm you are authorised to bind that firm.
Counsel to complete: the operating legal entity, its jurisdiction of incorporation, registered address, and the governing law and venue for disputes are not yet stated and must be before this is published.
2.What the service does
Talakay runs an automated multi-agent analysis over publicly available market data, regulatory filings, news and options data, and produces a directional view on whether a company will beat, miss or meet consensus earnings expectations, together with supporting reasoning and a record of how past views scored against actual results.
3.This is not investment advice
Nothing on this platform is investment advice, a recommendation, a solicitation, or an offer to buy or sell any security or financial instrument. We are not your broker, investment adviser, or fiduciary, and no advisory relationship is created by your use of the service.
Output is generated by large language models. It can be wrong, incomplete, internally inconsistent, or fabricated, including where it appears confident or cites specific figures. Model confidence scores describe the model’s own output, not the probability that any outcome will occur.
Past scoring accuracy does not indicate future accuracy. Any track record shown is a record of the system’s historical output, not a performance record of any investment strategy, and no representation is made that following it would have produced any return.
You are solely responsible for your own investment decisions and should conduct your own research and consult a qualified, licensed professional before acting. Trading securities and derivatives involves substantial risk of loss.
Counsel to review closely: this clause is the primary regulatory exposure. Whether the operator’s activity requires registration as an investment adviser (or equivalent) in each jurisdiction it serves, and whether this disclaimer is sufficient there, needs specific legal advice — not a template.
4.Your account
You must provide accurate registration information, keep your credentials secure, and are responsible for activity under your account. You must be old enough to enter a binding contract in your jurisdiction. We may suspend or terminate accounts that breach these terms.
5.Plans, billing and refunds
Paid plans are billed in advance through our payment processor on a recurring basis until cancelled. Plans include a usage allowance; when it is exhausted, metered features stop until the allowance resets or you upgrade.
You can cancel at any time from your billing settings. Cancellation stops future charges and takes effect at the end of the current period; you keep access until then.
Counsel to complete: refund policy, and the statutory cooling-off / withdrawal rights that apply to consumers in the jurisdictions served (these differ materially between the US, UK and EU).
6.Acceptable use
You agree not to:
- resell, redistribute or publish the output as your own research product
- scrape, bulk-export, or use the service to train a competing model
- attempt to access another user’s data or circumvent usage limits
- use the service unlawfully, including for market manipulation or insider dealing
7.Your content and your data
You keep ownership of any analysis, notes or data you supply. You grant us a licence to process it solely to operate the service for you. Analyses you generate are private to your account. Our handling of personal data is described in the Privacy Policy.
8.Third-party data and availability
The platform depends on third-party data providers and model providers. We do not warrant that their data is accurate, complete or available, and the service may be interrupted by their outages, rate limits or licensing changes. The service is provided on an “as is” and “as available” basis.
9.Limitation of liability
To the maximum extent permitted by law, we are not liable for any trading or investment losses, lost profits, or indirect or consequential damages arising from your use of the service. Nothing here excludes liability that cannot lawfully be excluded.
Counsel to complete: the liability cap and its carve-outs are intentionally left blank — the enforceable formulation is jurisdiction-specific.
10.Changes and contact
We may update these terms; material changes will be notified in advance and continued use after they take effect constitutes acceptance.
Counsel to complete: notice period for changes, and a contact address for legal notices.
